1.1. This Procedure regulates the relations between patients (women, men) and healthcare institutions that provide the application of assisted reproductive technologies (hereinafter referred to as HCI), and defines the mechanism and conditions for the application of assisted reproductive technologies.
1.2. In this Procedure, the terms are used in the following meanings:
assisted reproductive technologies (hereinafter referred to as ART) - methods of infertility treatment, in which manipulations with reproductive cells, certain or all stages of preparation of reproductive cells, processes of fertilization and development of embryos until their transfer into the patient’s uterus are carried out under in vitro conditions;
in vitro - a technique of performing experiments or other manipulations in special laboratory glassware or in a controlled environment outside a living organism.
1.3. Other terms are used in the meanings provided in the Fundamentals of the Legislation of Ukraine on Healthcare and regulatory legal acts in the field of healthcare.
1.4. ART is carried out in HCI that have a license to conduct medical practice, an accreditation certificate, appropriate equipment, and facilities according to Annex 1 to this Procedure.
1.5. Patients have the right to choose HCI for conducting ART.
1.6. ART procedures are conducted in HCI that have medical staff according to the staffing schedule approved in the HCI.
1.7. Adult women and/or men have the right to undergo treatment programs of ART according to medical indications.
1.8. The issue of applying ART methods is resolved after submitting an application by the patient/patients regarding the application of assisted reproductive technologies in the form provided in Annex 2 to this Procedure (hereinafter - Patient Application for Assisted Reproductive Technologies), a medical examination, and relevant testing.
1.9. The data of the medical examination and testing of patients are entered into the primary accounting documentation form No. 025/o "Outpatient Medical Card No. ___", approved by the order of the Ministry of Health of Ukraine dated February 14, 2012, No. 110, registered with the Ministry of Justice of Ukraine on April 28, 2012, No. 661/20974.
1.10. In the absence of contraindications for ART treatment programs, patients are referred for treatment to HCI upon availability of examination results. Patients can apply for treatment using ART methods directly, without a referral.
1.11. Working patients are issued a sick leave certificate after ART according to the Instructions on the procedure for issuing documents certifying temporary disability of citizens, approved by the order of the Ministry of Health of Ukraine dated November 13, 2001, No. 455, registered with the Ministry of Justice of Ukraine on December 4, 2001, No. 1005/6196.
1.12. Dispensary observation of a patient who has undergone ART is carried out according to the order of the Ministry of Health of Ukraine dated July 15, 2011, No. 417 "On the organization of outpatient obstetric and gynecological care in Ukraine".
1.13. The implementation of each ART treatment program is carried out with mandatory clinical monitoring and control of the patient's general condition. In case of violation of the treatment regimen by patients, further medical assistance using ART methods is terminated based on a justified decision by the doctor.
1.14. Medical assistance using ART methods is provided under conditions of confidentiality in accordance with Article 40 of the Fundamentals of the Legislation of Ukraine on Healthcare.
1.15. Medical workers providing medical assistance to patients using ART methods inform them about the possible ineffectiveness of ART attempts (non-pregnancy) and possible complications in the manner defined by Sections III, IV of this Procedure.
1.16. The collection and processing of personal data are carried out in compliance with the requirements of the Law of Ukraine "On Information" and the Law of Ukraine "On Personal Data Protection".
